The Innkeepers Act of 1939
CHAPTER 94
An Act to Incorporate the Innkeepers Guild of Nova Scotia.
(Passed the 15th day of April, A.D., 1939)
Be it enacted by the Governor, and Assembly as follows:
- 1 George Hart Dechman, of the Fairview Hotel, Bridgewater, Innkeeper,
James Donald Burton, of Braemar Lodge, Yarmouth, Innkeeper, Innkeeper, Forbes
Thrasher of the Lord Nelson Hotel, Halifax, Innkeeper, Robert Stanley Pitt,
of the Nova Scotian Hotel, Halifax. Innkeeper, Arthur Wellesley Stratford,
of the Gainsborough, Hubbards, Innkeeper, Harry Seaforth Morris, of the
Norfolk Hotel, New Glasgow, Innkeeper, Arthur Douglas Cossaboom, of the
Harbour View House, Smith's Cove, Innkeeper and Robert McHenry Ellis, of
the Pines Hotel, Digby, the Lakeside Inn, Yarmouth, and the Cornwallis Inn,
Kentville, Innkeeper, all of the Province of Nova Scotia, and their associates
and successors, and such other persons as are or shall become members of
the Guild hereby incorporated according to the rules and by-laws there-of,
are hereby created a body corporate under the name of the "INNKEEPERS'
GUILD OF NOVA SCOTIA".
- 2 In this Act unless the context otherwise requires:-
- (a) "Hotel" means an establishment available for the accommodation
and sustenance of the travelling public for compensation at which a staff
of uniformed servants is retained at least one member of which is on duty
at all hours of the night and day and containing for the use of guests, not
less than twenty bedrooms, one bathroom for every five bedrooms, two public
rooms, a public wash room with toilet or toilets, and one dining room or restaurant
where meals are served not less than three times daily at least between the
hours of 8 a. m. and 9 a. m., 12 noon and I p.m., and 6 p.m. and 7 p.m., at
each of which four alternative items of food are available and indicated on
a written, typewritten or printed menu card;

(b) "Cottage Colony" means a hotel as above defined which consists
of a small group of buildings surrounding a larger building with bedrooms
located either in the larger building and the smaller buildings or in the
smaller buildings only, and having in each of the smaller buildings a sitting
room in addition to a bedroom or bedrooms;

(c) "Inn" means an establishment available for the accommodation
and sustenance of the travelling pul)iic for compensation, containing for
the use of guests not less than: six bedrooms, one bathroom for every eight
bedrooms, one public room, and one dining room where meals are served between
at least the hours of 8 a.m. and 9 a.m., 12 noon and 1p.m., 6 p.m. and 7 p.m;

(d) "Cabin Colony" means a group of small buildings surrounding
or adjacent to a larger building, the whole being available for the accommodation
and sustenance of the traveling public for compensation, and containing, for
the use of guests, at least six bedrooms, with one bathroom for every eight
bedrooms, the bedrooms being located either in the larger building and the
smaller buildings or in the smaller buildings only and having, in the larger
building, facilities for providing meals for guests which are served either
in that building or in the smaller buildings and serving at least one meal
every day between the hours of 8 a.m. and 9 a.m.;

(e) "Tourist Home" means an establishment catering to the travelling
public for compensation, having available for the use of guests at least three
beds and one bathroom, and serving at least one meal per day between the hours
of 8 a.m. and 9 a.m.;

(f) "Innkeeper" means a person in active control of the management
of any Hotel, Cottage Colony, Inn, Cabin Colony or Tourist Home whether such
person bears the title of manager or not;

(g) "Establishment" includes Hotel, Cottage Colony, Inn, Cabin Colony
or Tourist Home;

(h) "The Guild" means the unincorporated association heretofore
known as The Innkeepers' Guild of Nova Scotia;
-
(i) "This Corporation" means the body corporate by this act created.

3 The objects, aims and purposes of this corporation shall be:
-
(a) to regulate and improve the standard of catering to the travelling public
by the Innkeepers of Nova Scotia .

(b) to promote and further the interests of Innkeepers in Nova Scotia;
-
(c) To enforce all the regulations made by, under or pursuant to the Public
Health Act 1938 which affect Hotels, Cottage Colonies, Inns, Cabin Colonies
and Tourist Homes of or under the control or management of members of this
corporation.

4 The By-Laws of the Guild in force at the time of the coming into force of
this Act are hereby declared to be the By-laws of this Corporation, and the
said By-Laws may from time to time be repealed, altered or added to by the
Directors of this Corporation for the purpose of furthering the objects of
this Corporation.

5 This Corporation is hereby authorized and empowered:
-
(a) To acquire, take and hold, by purchase, grant, lease or gift, real and
personal property including money, and receive the rents and profits of the
said real and personal property and invest any monies received and sell, lease,
nmortgage or otherwise dispose of any such real and personal property as may
be deemed most advantageous for carrying out the objects of this Corporation;
-
(b) To erect or cause to be erected such buildings or other structures of
a permanent or temporary nature as may be deemed advantageous for carrying
out the objects of this Corporation and to lease, mortgage, sell or otherwise
dispose of the buildings and structures so erected as the Directors may deem
advisable;

(c) To loan money to any member of this Corporation for purposes in furtherance
of the objects of the said Corporation, upon such terms and such rate of interest
not less than 4% as the Directors may in any case determine;

(d) To make, draw, endorse, discount, execute and issue promissory notes,
bills of exchange or other negotiable or transferable instruments;

(e) To make contracts for the purposes of this Corporation;

(f) To maintain a register of the names, and descriptions of all establishments
in Nova Scotia offering accommodation and sustenance to the travelling public
for compensation, which have been approved by this Corporation as complying
with all regulations made by, under or pursuant to the Public Health Act,
1938;
-
(g) To employ as an emblem a white shield and superimposed thereon a black
lion rampant with tongue and claws red, holding a blue key, and to distribute
such emblem amongst the members of this Corporation in the manner provided
by the By-laws of the Guild, but no such emblem shall be distributed to any
member until the establishment which he represents has been approved by the
Inspector appointed by this Corporation as complying with all regulations
made by, under or pursuant to the Public Health Act, 1938.

6 All the property which before the coming into force of this Act was vested
in or held in trust for the Guild, is hereby vested in and shall belong to
this Corporation and the said Corporation shall be accountable for all debts,
engagements, and liabilities of the Guild at the date of incorporation.

7 (a) The Corporation may appoint an Inspector or Inspectors to carry out
the provisions of this Act.

(b) The duties of such Inspector or Inspectors shall be to examine any and
all establishments of or under the control or management of members of this
corporation, and which offer accommodation and sustenance to the travelling
public for compensation.

8 Any person who displays on or about any building the emblem of this Corporation
or any sign indicative of or which might be taken as indicative of membership
in this Corporation, unless he be a member of this Corporation and unless
the building in respect of which such emblem or sign is displayed has been
approved by the Inspector of this Corporation as comlying with all regulations
made by, under or pursuant to the Public Health Act. 1938, shall he liable
to a penalty not exceeding ($500.00) Five Hundred Dollars.

9 This Act shall not apply to restaurants, tearooms or other establishments
which offer food without lodging to the travelling public.
